These terms govern your use of Mesr. Please read them — section 3 in particular, because it explains what a Mesr measurement is and, just as importantly, what it is not.

We are registered for VAT; our VAT number is shown on invoices and available on request. Prices shown on Mesr are exclusive of VAT, which is added at the applicable rate.
By using Mesr you accept these terms. If you do not accept them, please do not use the service.
Mesr is intended for use by businesses — typically lawn-care, landscaping, groundworks and grounds-maintenance firms quoting for work. If you are using Mesr wholly or mainly for purposes outside a trade or business, you are a consumer and nothing in these terms removes rights you have under UK consumer law that cannot be excluded by agreement.
You must be at least 18 years old to hold an account.
Mesr estimates the area of outdoor spaces from satellite and aerial imagery, from GPS points you record on site, or from shapes you draw by hand. It exists to help you produce a quote quickly.
A Mesr measurement is indicative only. It is not a legal survey, not a boundary determination, and not evidence of the extent of anyone's title to land. Areas derived from imagery depend on the age, angle and resolution of that imagery. Areas derived from GPS depend on the accuracy your device reports, which varies with sky visibility, tree cover and hardware.
Plot outlines shown on the map come from public data and indicate approximate extents. They are not a statement of where a legal boundary lies.
You are responsible for checking any figure before you rely on it. If you use a Mesr measurement to price work, you do so on your own commercial judgement. We do not warrant that any measurement is accurate to any particular tolerance, and we are not a party to any contract you enter into with your own customers.
Do not use Mesr as the basis for a boundary dispute, a land registration, a planning application, a valuation, or any other purpose requiring a surveyed measurement. Instruct a chartered surveyor for those.
Signing in to Mesr is by emailed link. We send a single-use link to your email address; following it signs you in. There is no password to remember or lose.
Drawing, GPS measuring, matching to a plot boundary and Costings are free and unlimited. AI garden detection is metered: new accounts receive ten free detections; after those are used you continue either on your own AI key (section 6) or on a paid plan.
Paid plans are launching shortly. Nothing is charged today, and the free AI detections above are unaffected. The pricing below is a preview of what will be on offer, all figures exclusive of VAT.
A subscription renews automatically each billing period until cancelled. You can cancel at any time from the account menu; cancelling stops the next renewal and your access continues until the end of the period already paid for. Overage bundles are one-off purchases, delivered immediately.
Where you buy as a consumer, you would ordinarily have 14 days to cancel a distance contract for a new subscription or an overage bundle; by starting a subscription or completing a bundle purchase and gaining immediate access, you ask us to begin supply at once and acknowledge that you lose that cancellation right once the bundle has been supplied, or once the subscription's first period has begun.
Where you buy as a business, the statutory cancellation right does not apply. Amounts already paid for a current period or a bundle are non-refundable except where we are at fault.
None of this affects your right to a remedy if what we supplied was faulty or not as described. If something has gone wrong, email support@konsul.co.uk and we will put it right.

We may suspend or close an account that breaches this section, and may do so without notice where the breach is serious or ongoing.
The measurements you create, the addresses you look up, and any rates you enter remain yours. We claim no ownership of them.
You grant us only the permission we need to run the service: to store your measurements so you can return to them, to process imagery for a detection you have asked for, and to produce the exports and documents you request.
Your cost and sale rates are commercial information. They are stored on your own device and are not transmitted to us, so we cannot see them, disclose them, or produce them if asked to.
Mesr, its software, design, brand and the "measure" mark are owned by Konsul and protected by copyright and other intellectual property rights. Nothing in these terms transfers any of those rights to you. You are granted a limited, non-exclusive, non-transferable, revocable licence to use Mesr for its intended purpose.
Mesr displays data licensed from third parties, which remains theirs and is subject to their terms:
Attribution shown on the map and on exported documents must not be removed or obscured.
AI garden detection proposes a shape from an aerial image. It is a starting point, not an answer.
Aerial images sent for detection are images of property taken from public satellite imagery.
We aim to keep Mesr available but we do not guarantee uninterrupted service. Mesr depends on third-party mapping, data and AI providers, and an outage at any of them may interrupt part or all of the service.
We may add, change or withdraw features. Where a change materially reduces what you have already paid for, we will tell you and offer a fair remedy.
We may update these terms. The version in force is the one published on this page, and the "last updated" date above tells you when it changed. Where a change is significant we will make reasonable efforts to notify account holders by email. Continuing to use Mesr after a change takes effect means you accept the updated terms.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

If you are a consumer, this section applies only so far as the law allows, and your statutory rights are unaffected.
We process personal data in accordance with UK GDPR and the Data Protection Act 2018. A plain-English summary of what we hold and why is in the Your data and privacy section of the help pages.
In short: we use your email address to sign you in, to keep your measurements together, and to contact you about Mesr. We do not sell your data. To obtain a copy of your data, correct it, or have it deleted, email support@konsul.co.uk. You may also complain to the Information Commissioner's Office at ico.org.uk.
You may stop using Mesr at any time and delete your account from the account menu. Deleting your account removes your measurements and any stored key.
We may suspend or end your access if you materially breach these terms, if we are required to by law, or if we withdraw the service. Where we withdraw the service entirely, we will give reasonable notice and refund credits you have bought but not used.
Unused credits are forfeited if you delete your own account.
